Stage 1: First Missed Payment to Notice of Default (120+ Days)

Federal law under 12 C.F.R. § 1024.41 requires your mortgage servicer to wait at least 120 days after your first missed payment before formally starting foreclosure. This is your longest window and the one most homeowners waste. During this period, your servicer is required by federal law to offer loss mitigation options. What you should do during this period: contact your servicer in writing and keep records of every conversation. Ask specifically about loss mitigation options. If selling is the more realistic path, this is the longest window you will have before the legal process narrows your options.

Stage 2: Notice of Default (NOD)

The Notice of Default is mailed to you and posted on the property by the trustee. It starts the formal foreclosure clock under RCW 61.24. It activates your right to request Foreclosure Fairness Act mediation through a housing counselor or attorney. You cannot self-refer — a counselor or attorney must refer you. After the NOD is recorded, the trustee must wait at least 30 days before recording the Notice of Trustee’s Sale. If you request mediation before the NOTS is issued, the foreclosure timeline stops while mediation proceeds.

Stage 3: Notice of Trustee’s Sale (NOTS)

The NOTS sets the sale date. The sale must be at least 120 days after this notice is recorded in most residential Washington cases. The notice is recorded with the county auditor, mailed to you, and posted on the property.

You have 20 days from the NOTS to request Foreclosure Fairness Act mediation. After 20 days, the mediation referral window closes. The Washington Homeownership Resource Center can help if you received the NOTS recently.

Stage 4: The 11-Day Reinstatement Cutoff

Under RCW 61.24.040 and 61.24.090, you have the right to reinstate your loan — cure the default by paying all arrears, late fees, and trustee costs — up to 11 days before the sale date. Stage 5: The Trustee Sale
