
Immediately After the Trustee Sale
Once the trustee completes the sale, the property transfers to the winning bidder via a Trustee’s Deed. Under Washington nonjudicial foreclosure law, you have 20 days from the date of sale to vacate the property. The new owner can begin unlawful detainer (eviction) proceedings if you have not vacated by that date.
There is no post-sale redemption period in Washington under nonjudicial foreclosure law (RCW 61.24.050). You cannot buy the property back after the trustee sale. The sale is final.
The No-Deficiency Judgment Rule — What It Means
Under RCW 61.24.100, no deficiency judgment is allowed following a nonjudicial foreclosure in Washington. The lender cannot sue you personally for the difference between what the property sold for and what you owed on the mortgage. This is one of Washington’s most important homeowner protections and one that most borrowers facing foreclosure are not aware of.

After a pre-foreclosure sale, FHA guidelines typically require a 3-year waiting period before you can obtain a new FHA-backed mortgage. After a completed foreclosure, the same 3-year FHA waiting period applies from completion — but in practice, the combined credit damage makes qualifying for any mortgage more difficult for 4 to 7 years. The difference between a pre-foreclosure sale and a completed foreclosure is not just the credit score number. It is the timeline to your next housing situation.
What If There’s a Surplus After the Trustee Sale?
If the trustee sale produces more than the outstanding loan balance plus fees, the surplus belongs to the former homeowner. In the current Snohomish County market, surplus situations do occur. The surplus is distributed through a process managed by the trustee, and claiming it requires prompt action. What Happens to Property Taxes After Foreclosure?
Mortgage foreclosure and property tax foreclosure are separate processes in Washington. Snohomish County conducts a separate annual tax lien foreclosure for properties with property taxes at least 3 years delinquent. In 2026, the target is properties with unpaid 2023 or prior-year taxes.
